The City of Vallejo Property Maintenance Ordinance
The City of Vallejo adopted a Property Maintenance Ordinance, the purpose of which is to enhance and promote the maintenance of real property and by doing so improve the livability, appearance, and social and economic conditions of the community. The intent also is to elevate the self esteem of the residents of the community, develop a cohesive and caring sense of community, thereby contributing to the growth and prosperity of the City of Vallejo.
PROPERTY MAINTENANCE ORDINANCE
7.54.030 UNLAWFUL PROPERTY NUISANCES
A. Vacant buildings.
B. Unpainted buildings, buildings having dry rot warping, or termite infestation.
C. Windows with broken glass or no glass.
D. Building exteriors, walls, roofs, accessory structures, driveways, walkways of alleys that are deteriorated or in disrepair.
E. Accumulation of dirt, litter, or debris.
F. Damaged lumber, junk, trash, salvage materials, household materials, etc.
G. Attractive nuisances dangerous to children such as abandoned household appliances, equipment and machinery, hazardous pools, ponds and excavations.
H. Construction equipment or machinery visible to the public.
I. Signs related to uses or products no longer sold on the property, or improper maintenance of signs.
J. Vehicles, RV's, trailers and boats parked in front yard in residential zoning districts.
K. Dead, decayed, diseased or otherwise hazardous trees, weeds or overgrown vegetation.
L. Clotheslines, or drying of laundry in front area of property.
M. Any wall, fence or hedge maintained in a condition of deterioration or disrepair as to constitute a hazard to persons or property.
N. Any property with pooled oil accumulation or grease.
O. Any yard area which causes excessive dust or debris.
P. Graffiti.
Q. Accumulation for an unreasonable amount of time of concrete, dirt, sand, gravel, or other similar materials.
R. Leaving any garbage can, refuse can, or recycling container in front or side yard.
S. Maintenance of property in such a manner as to constitute a public nuisance.
UNLAWFUL PROPERTY NUISANCES - PENALTIES
The City will seek voluntary compliance of the Property Maintenance Ordinance whenever possible. Should it become necessary the Ordinance provides severe penalties:
1) Administrative Fee - $280 Administrative Fee with notice of violation.
2) Criminal Citation - Maximum penalty $500 fine and/or six (6) months in County Jail.
3) Administrative penalties - Up to $750 per section per day each and every day the violation exists.
4) The City can have the work done at the owners expense.
5) If the violation involves public health of safety (substandard housing) the City may cause the owner of a rental income property to lose State tax deductions for interest, taxes, depreciation or amortization paid or incurred in a taxable year.
